COMPARATIVE STUDY OF OWNERSHIP GOOD OF FINDINGS WHICH CARRY FLOOD FLOWS BY THE MAZHAB OF IMAM SYAFI'I AND IMAM HANAFIYYAH

Abstract
Human life always comes from various places that never stop appearing, one of which is the problem of goods after the flood. The conclusion obtained is that according to the opinion of the Imam Syafi'i School with Imam Hanafiyyah regarding ownership of the found items, it is almost the same that every person who discovers the found items must announce and return the items within one year. The researcher formulated the problem form as follows: what is the opinion of the Imam Shafi'ite school and Imam Hanafiyah school of ownership of found items (luqathah) and how the Imam Syafi'i School and Imam Hanafiyyah School of ownership of the findings in the event of flooding. This study aims to answer the problem formulation. The research method used is a qualitative method. Source of data used primary data is data obtained directly from local residents through interviews and secondary data, namely through the study of literature relating to the object under study. Based on the results of the study, the conclusion obtained according to the Imam Shafi'i School explains that when the person who finds the item is trustful, it is rewarded to save it and return it when it has met with the owner because by participating in saving the item means helping to protect it from loss. Events that occur after the flood in the community many who take goods to own and control, whereas in the view of Imam Syafi'i and Imam Hanafiyyah regarding ownership of found items that anyone can have it as long as they are able to take good care of it and must return the found items caused by the flood to their owners within one year.
