Paper overview
Abstract
The rise of cryptoassets has brought a set of conceptual problems to the fore. These include whether cryptoassets should be considered “property” in English law, what species of property they should be, and, if they are property, how they are transferred (and also lost, stolen, bailed, gifted, converted, etc). In this article, the author explores whether the doctrine of negotiability has any place in the brave new world of blockchain-based financial assets.
